§ 3 Recipients of personal data
We may disclose or transfer personal data to external partners who process such data on our behalf and in accordance with our instructions. These partners act as data processors or, in certain cases, as independent data controllers, depending on the purpose of the processing. Disclosure shall only take place to the extent necessary to fulfill our obligations towards you or in accordance with applicable law.
Personal data may be disclosed to the following specifically defined categories of recipients:
3.1 Distributors and Carriers
Information regarding your name, delivery address, email address, telephone number, order number, and any specific delivery instructions may be disclosed to distributors and carriers responsible for handling, distribution, and delivery of the goods you have ordered.
The disclosure of such information is necessary in order to perform the contract with you and to complete delivery of your goods, cf. Article 6(1)(b) of the GDPR. Distributors and carriers process personal data either as data processors on our behalf or as independent data controllers in connection with their delivery services. Where they act as independent data controllers, processing is carried out in accordance with their own privacy policies.
3.2 Providers of Technical Infrastructure
We use providers of technical infrastructure for the operation, hosting, maintenance, security, and monitoring of our website and associated systems. These providers supply the technical platform that enables us to deliver our services in a stable and secure manner. These providers process personal data as data processors and solely in accordance with our instructions.
It is important to emphasize that your personal data is not shared with these providers for their independent use. These technical infrastructure providers act exclusively as our data processors, subject to our instructions and contractual agreements. Some of these providers may be located outside the EU/EEA, which entails a transfer of your personal data to third countries. For further information on such transfers, please refer to §4 on transfers to third countries.
3.3 Providers of Customer Service Infrastructure
In order to provide customer service and support, we use systems for managing customer communications, including email, chat, telephone, and automated support solutions. In this context, personal data such as your name, contact details, and the content of your inquiry may be processed.
3.4 Providers of Payment Services
In connection with purchases and payments, personal data may be disclosed to payment service providers for the purpose of completing transactions, administering payments, and preventing fraud. The data processed typically includes contact details and transaction-related information. This processing is necessary for the performance of a contract with you, cf. Article 6(1)(b) of the GDPR.
3.5 Providers of Marketing and Communication Services
We may use external providers to distribute marketing communications, including emails, messages, and other forms of direct communication. In this context, contact details and information regarding your preferences may be processed. Processing for marketing purposes will only take place on the basis of your consent and provided that you have not objected to such processing.
Some of these partners may be located outside the EU/EEA, which entails a transfer of your personal data to third countries. For further information on such transfers, please refer to §4 on transfers to third countries.
3.6 Providers of Advertising and Analytics Services
We use analytics and advertising tools to measure the use of our website and to target our marketing, including platforms such as Meta (Facebook and Instagram), Google (Google Ads, Google Analytics, YouTube), TikTok, Snapchat, and similar services. This may involve the use of cookies and similar technologies as well as the sharing of pseudonymized or encrypted identifiers.
Processing only takes place where you have given your consent, where such consent is required. Several of these providers act as independent data controllers with respect to their own processing of personal data.
The manner in which your data is collected by advertising partners also determines their role in the processing of your data. However, most of our advertising partners act as independent data controllers. Some of these advertising partners are located outside the EU/EEA, which entails a transfer of your personal data to third countries. For further information on such transfers, please refer to §4 on transfers to third countries.
3.7 Public Authorities
We may disclose personal data to public authorities where required by law or where necessary to establish, exercise, or defend legal claims. In such cases, processing is carried out on the basis of Article 6(1)(c) or (f) of the GDPR.
§ 4 Transfers to Third Countries
Certain of the partners and service providers who process personal data on our behalf are established outside the EU/EEA. In such cases, personal data may be transferred to third countries. Transfers of personal data to third countries may in particular take place to the United States, including where certain of our partners and service providers are established.
Transfers of personal data to third countries shall only take place where such transfers are permitted under applicable data protection legislation and provided that an adequate level of protection for the data subjects’ personal data is ensured. This entails that we apply a valid transfer mechanism in accordance with the EU General Data Protection Regulation.
As a general rule, transfers to third countries are based on the European Commission’s Standard Contractual Clauses, cf. Article 46 of the GDPR, and, where required, supplementary technical and organizational measures are implemented to safeguard the personal data. To the extent that the European Commission has adopted a valid adequacy decision for a third country, transfers may be carried out on this basis.
Transfers to third countries may occur in connection with the use of:
- technical operations and hosting solutions
- customer service and communication systems, including chat and support functions
- analytics, monitoring, and security tools
- marketing and advertising platforms
In connection with the use of automated chat and support solutions, information that you provide during your interaction may be processed by external service providers. These providers act solely as data processors in accordance with our instructions, do not use the information for their own purposes, and process the information only for the purpose of responding to your inquiry. The information is not retained longer than necessary and is subject to appropriate technical and organizational security measures, including encryption.
